H-1B vs a Remote Developer in India: Cost, Timeline and Risk Compared (2026)

H-1B vs a Remote Developer in India: Cost, Timeline and Risk Compared (2026)

When a US company needs a senior engineer it cannot find locally, there are two common routes. You can sponsor a foreign engineer on an H-1B visa and bring them to the US, or you can hire an engineer who stays where they are and works with your team remotely.

Both can work well. They differ enormously in cost structure, timeline and risk, especially after the H-1B changes of 2026. This guide compares them side by side so you can choose the right route for each role.

This article is a business comparison, not legal advice. Fees change; confirm current amounts with USCIS or an immigration attorney before filing.

Cost: what an H-1B actually costs an employer

These are the standard US government fees for a new cap-subject H-1B petition in 2026:

FeeSmall employer (25 or fewer US staff)Larger employer
Registration$215$215
Form I-129 filing$460$780
ACWIA training fee$750$1,500
Fraud prevention fee$500$500
Asylum program fee$300$600
Total before options$2,225$3,595
Premium processing (optional)$2,805$2,805

On top of government fees, most employers pay an immigration attorney, and the employee must be paid at least the prevailing wage for the role and location, which in US tech means a full US salary.

Two larger amounts are in the news but are not being collected today. The $100,000 payment introduced in 2025 has been blocked by federal courts, and a separate $103,265 fee proposed by DHS in August 2026 is still only a proposal. Either could change during the next filing season, which is part of the risk you are taking on.

Cost: what a remote developer in India costs

A remote developer hired through a development company has no visa fees, no attorney fees and no relocation. You pay a monthly or hourly rate to the partner, who handles salary, equipment, taxes and replacements on their side.

Typical 2026 rates for developers hired through a company in India:

SeniorityHourlyMonthly (full-time, dedicated)
Mid-level (2 to 5 years)$18 to $35$2,800 to $5,500
Senior (5+ years)$30 to $60$4,800 to $9,500
Senior AI, cloud or DevOps$45 to $90$7,000 to $14,000

Timeline: the biggest difference

The H-1B calendar is fixed:

  1. March: employers register candidates during a short window.
  2. By March 31: USCIS selects registrations.
  3. April 1 to June 30: selected employers file petitions.
  4. October 1: the earliest the employee can start under the cap.

That is six to seven months from registration to first day, if everything goes right. If your candidate is not selected, the next chance is the following March, which pushes the start out by a full year.

A remote developer through a partner can typically be matched in days and productive within the first week or two. For a role blocking your roadmap right now, that difference often decides the question on its own.

Odds: the lottery got harder for startups

For the FY 2027 season, the lottery switched from purely random selection to a process weighted toward higher wages. USCIS received about 211,600 eligible registrations for a cap of 85,000 visas, and only 17.7% of those selected were at the lowest wage level.

If you are a startup offering a competitive but not Big Tech salary, your candidate's odds are lower than they used to be. A remote hire carries no lottery risk at all.

Risk: be honest about both sides

H-1B risks in 2026:

  • Fee rules are being decided in court and could change before you file.
  • Lottery odds now depend on the wage level you offer.
  • Enforcement attention on skilled immigration is rising, including the October 2026 green card suspensions for eight large companies.

Remote hiring risks:

  • Quality varies widely between providers, so test before you commit.
  • You need a few hours of timezone overlap and clear communication habits.
  • The proposed HIRE Act would add a 25% excise tax on certain US payments to foreign service providers. It was introduced in 2025 and has stalled in committee, so it is not law, but it is worth watching if you plan to scale an offshore team.

When each option is the right choice

Choose H-1B sponsorship when:

  • The person must work on site in the US.
  • You are building a long-term core team and want a path to permanent residence.
  • You can wait until October, and plan for the chance of waiting another year.

Choose a remote developer when:

  • The role is blocking work now.
  • You want to avoid lottery and policy uncertainty.
  • You want to test the fit with a short pilot before committing.
  • You need specialist skills, such as AI or DevOps, for a defined period.

Many companies do both: sponsor a small number of critical on-site roles and use remote engineers for the rest of their capacity.

How to make a remote hire work

  • Start with a paid pilot of about a week on a real task.
  • Keep code and accounts in your company's name from day one, with IP assigned to you in the contract.
  • Agree on overlap hours and written daily updates.
  • Treat remote engineers as teammates, with the same standups, reviews and onboarding as everyone else.

Frequently Asked Questions

How much does it cost to sponsor an H-1B in 2026?

Standard US government fees for a new cap-subject petition total about $2,225 for small employers and $3,595 for larger employers, plus $2,805 if you choose premium processing. Attorney fees and a salary at or above the prevailing wage come on top. The $100,000 payment is currently blocked by courts.

How long does it take to hire someone on an H-1B?

Registration happens in March and approved employees can start no earlier than October 1, so about six to seven months if the candidate is selected. If they are not selected, the next opportunity is a year later.

Is hiring a remote developer in India cheaper than an H-1B?

Usually, yes. A remote developer through a partner involves no visa or attorney fees, and senior rates in India are typically $30 to $60 per hour compared with full US salaries for H-1B employees. The bigger advantage is often speed and certainty rather than cost alone.

Do remote developers in India need a US visa?

No. Developers working remotely from India for a US company through a development partner do not need a US work visa.

What is the HIRE Act and does it affect outsourcing?

The HIRE Act is a bill introduced in 2025 that would impose a 25% excise tax on certain payments by US companies to foreign service providers. It has stalled in committee and is not law.
